Texas Education Code Section 22.0834 requires that all teachers have either a name-based background check or fingerprint-based criminal history background check that is run through the Texas Education Agency (“TEA”). The results of these TEA background checks are stored in the Texas Department of Public Safety (“TxDPS”) Fact Clearinghouse. TxDPS no longer allows non-school entities such as Swing Education (“Swing”) to access these background checks in the Fact Clearinghouse (“Clearinghouse”) therefore our schools partners must review the TEA background check for SwingSubs. The personal information collected during account setup* is required to (i) sign you up to get fingerprinted through TEA, and (ii) for our school partners to access your background check results in the Clearinghouse. When you accept your first request at a particular school, that school may review and subscribe to updates on your background check.

As part of the sign-up process to work through the Swing Education platform, Swing Education will also check the public Texas Do Not Hire registry in accordance with House Bill 3. If your name appears on the public registry, either during the sign-up process or thereafter, you will receive an email from Swing Education with next steps.

Note: If you were previously onboarded with Swing in Texas, we may have asked you for some of the above information earlier. We were allowed to access the Clearinghouse directly before 2021, so we obtained this information from you in order to access the Clearinghouse ourselves, but in the interest of your privacy we did not store it.

By filling out and submitting the PII information required during account setup*, I hereby certify that this information is true and correct to the best of my knowledge. I understand that any misrepresentation, falsification, or omission of any information may result in delays in my setup process with Swing Education and/or my removal or termination from the Swing Education platform.

I hereby authorize Swing Education to upload this information to the Texas Education Agency in order for TEA to process my background check in accordance with Texas Education Code Section 22.0834. I further authorize Swing Education to share this information with Swing Education’s partner school(s), and such partner school(s) to use this information to obtain and subscribe to my background check results in the TxDPS Fact Clearinghouse. I understand that such school(s) will determine, at their sole discretion, whether I am permitted to work at their campus on the basis of these TEA fingerprint-based background check results.

I hereby release Swing Education and its partner schools from all liability in connection with the above disclosures and related decisions.
